Our attorneys handle a wide variety of construction payment and defect disputes relating to both private and public jobs and in both the residential and commercial contexts. We are proud to currently serve as general counsel for numerous general contractors and subcontractors. In addition to serving as their registered agent and maintaining their corporate books, we guide them on their contract forms and assist them with all their general collections work. We perfect construction liens for them, filing and serving notices to owner, claims of lien, and contractor’s affidavits as applicable and needed. Where applicable we perfect surety bond claims. We then represent those clients as needed in lien foreclosure litigations and/or in Miller and Little Miller Act claims against sureties across the state. We have experience prosecuting and defending small and large construction defect claims in varying contexts ranging from claims in the single family residence context to class type claims for numerous condominium unit owners in the multi-party context. We commonly defend contractors in administrative complaints brought before the licensing board of the Department of Business and Professional Regulation. We handle claims for aggrieved homeowners brought before the Board seeking relief under the State Recovery Fund. Our firm has unique experience representing restoration contractors who commonly perform work following storm events, such as water remediation, mold remediation and roofing work. Property owners typically contract with our clients to perform such work by assigning their insurance benefits (AOB’s) to our clients. We commonly consult with our clients regarding their AOB rights and represent them in litigations arising out of or relating to same.
